Is the criminal a mental patient?

In my previous post, I discussed about what a mental disorder is. In this post, I will look into the definition of mental disorder in the forensic perspective. As we know that some criminals, after committed a crime claim that they had mental disorder. Whether they were truly mental patients is a question that is addressed by forensic psychologists. In most cases the diagnosis of a mental disorder is not sufficient to establish the existence for legal purposes of a “mental disorder,” “mental disability,” “mental disease,” or “mental defect.” In order to determine if an individual meets a legal standard, some additional information is needed, for example, to what extent the impairment is affecting the person’s life.

In order to determine that the person has conducted the crime not because he was mentally ill, but because of his ill-intentions, the help of both clinical psychologists and forensic psychologists is needed, along with consultation from non-clinical decision makers.

It should also be noted that an individual diagnosed of a mental disorder can be capable to control his criminal intentions/ acts, thus, having the diagnosis in itself does not demonstrate that a particular individual is (or was) unable to control his or her behavior at the time of crime.

Thus, while determining an individual to be a criminal, while he claims that he is a mental patient, several factors should be taken into consideration before making a final judgement.

Is there a comprehensive definition of mental disorder available in the literature?

Mental disorder is not easy to define. It is a broad area and there is no single definition in the literature that covers all the situations and medical conditions that characterize a mental disorder. A person can be categorized a having a disorder (physical or mental) on the basis of structural pathology, symptom presentation, deviance from a physiological norm, and etiology.

Different researchers have attempted to define a mental disorder on the basis of concepts such as distress, disability, irritability, inflexibility, irrationality etc. Each of these can indicated a mental disorder, however, a comprehensive definition is still lacking. DSM has attempted to define a mental disorder as:

“ a clinically significant behavioral or psychological syndrome or pattern that occurs in an individual and that is associated with present distress (e.g., a painful symptom) or disability (i.e., impairment in one or more important areas of functioning) or with a significantly increased risk of suffering death, pain, disability, or an important loss of freedom. In addition, this syndrome or pattern must not be merely an expectable and culturally sanctioned response to a particular event, for example, the death of a loved one. Whatever its original cause, it must currently be considered a manifestation of a behavioral, psychological, or biological dysfunction in the individual. Neither deviant behavior (e.g., political, religious, or sexual) nor conflicts that are primarily between the individual and society are mental disorders unless the deviance or conflict is a symptom of a dysfunction in the individual”.

So I think any condition that hinders a person from doing their day-to-day duties can be classified as mental disorder, such as depression, where a person loses all his motivation to live fully.

Mindfulness practices decreases depression

In a study conducted at five middle schools in Belgium, involving about 400 students (13 ~ 20 years old), Professor Filip Raes concludes that “students who follow an in-class mindfulness program report reduced indications of depression, anxiety and stress up to six months later. Moreover, these students were less likely to develop pronounced depression-like symptoms.”
Another study, from the University of California, made with patients with past depression, concluded that mindfulness meditation decreases ruminative thinking and dysfunctional beliefs.
Yet another concludes that mindfulness meditation may be effective to treat depression to a similar degree as antidepressant drug therapy”.
